South padre island adventures reserves the right, at any time, to modify, alter, or update these terms of use, and you agree to be bound by such modifications, alterations, or updates.

South Padre Island Adventures occasionally obtains item photographs from third party recreational activities, vendors and/or manufacturers. We do not investigate to determine if information is not accurate nor can we provide assurance that all data is free of typographical errors. We cannot guarantee information displayed on the Web site to be 100% accurate.
Reservation / Order Acceptance
All Reservations must be verified 24 hours in advance of your scheduled activity. The receipt of an e-mail reservation or order confirmation does not constitute the acceptance of a reservation, order or a confirmation of an offer to sell. South Padre Island Adventures reserves the right, without notification, to limit the number of reservations placed or order quantity on any activity or item and/or refuse service to any customer. Verification of information may be required prior to the acceptance of any order.
CANCELLATION POLICY ENFORCED. NO EXCEPTIONS!
We have a 24 hour cancellation policy for non-group bookings. If you cancel your reservation more than 24 hours prior to your activity date, your payment, less a $20 per person administration fee, will be refunded to you. If you need to change your reservation date or time, you may do so one time at no charge, as long as you contact us more than 24 hours prior to your originally scheduled activity. No refunds or ticket transfers will be given with less than 24 hours notice. There are NO EXCEPTIONS including weather related issues. A “rain-check” MAY be issued for cancelled or shorted activity due to weather. This “rain-check” is valid for 12 months and may only be redeemed by the original participant.
Groups booked through Group Sales must have final head count and deposit submitted 7 days prior to tour date. No refunds/rain checks will be given less than 7 days to tour date. NO EXCEPTIONS!
Once you reserve a spot, you are locked in. There are no refunds. If you arrive for the activity and you cannot complete the activity due to fear, we will give you a six month rain check. We encourage you to try again. The rain check is specifically for you and cannot be transferred to another person. If you are late for your activity, you will not receive a refund or be able to join your tour. Your tour and tour guides will leave as scheduled whether you are there or not. We expect you to arrive 30 minutes prior to your reserved tour time to enable you to check in and complete the necessary paperwork.
Payment Policies:
You are responsible for, and agree to pay promptly your account, including applicable taxes. In the event a check is returned or electronic payment is denied, South Padre Island Adventures may impose a fee to cover the cost of any charges incurred. If you fail to pay any invoices or charges on account, when due, South Padre Island Adventures may charge such amount directly to the credit card identified in your Customer profile and South Padre Island may suspend or terminate your access to our online service. You shall be responsible and liable for any fees, including attorneys’ fees and collection costs, that South Padre Island may incur in its efforts to collect any unpaid balances from you. Your right to use the South Padre Island Adventures online service is subject to limits established by South Padre Island Adventures. If payment cannot be charged to your credit card or a payment is returned to for any reason, including chargeback, South Padre Island Adventures reserves the right to suspend or terminate your access to the online service and your customer account.
Account Information:
South Padre Island Adventures’ secure server encrypts your credit card and other information so that it cannot be read as the information travels over the Internet. Once we receive your credit card information, it is stored in our secure server. South Padre Island Adventures will exercise commercially reasonable efforts to ensure that your credit card information remains confidential, and is available only to personnel who have a need to know such information in connection with providing you the our online service.
In servicing your account, South Padre Island Adventures, may also collect addresses, contact names, names, telephone numbers and fax numbers, as well as e-mail addresses. This data may be used by South Padre Island Adventures for the purpose of improving customer service and/or offering or furnishing products and services of South Padre Island Adventures. It is our policy that we would not provide collected data to third-parties outside of South Padre Island Adventures unless it is necessary to do so in order to enable us to provide an appropriate level of service to users.
Suspension of Service:
South Padre Island Adventures may suspend or terminate their online service at any time for any reason with or without notice to you. South Padre Island Adventures reserves the right to collect any outstanding fees and charges incurred before canceling your online service.
Limitation on Liability:
IN NO EVENT SHALL SOUTH PADRE ISLAND ADVENTURES OR ITS SUBSIDIARIES, AFFILIATED COMPANIES, EMPLOYEES, OFFICERS, DIRECTORS OR REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, COVER, PUNITIVE, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER, EVEN IF SOUTH PADRE ISLAND ADVENTURES HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER IN AN ACTION UNDER CONTRACT, NEGLIGENCE, OR ANY OTHER THEORY, ARISING OUT OF OR IN CONNECTION WITH THE — USE, INABILITY TO — USE, OR PERFORMANCE OF THE SERVICES AND INFORMATION AVAILABLE FROM THIS SITE. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND/OR CLAIMS OF THIRD PARTIES.

Tax Exempt Transactions:
This site does not support tax exempt transactions for certain Tax Exempt Organizations, Charitable or Commercial Customers. All qualified tax exempt transactions can be made by calling (956) 761-4677 or at our location. If you are a customer with a company or business that is tax exempt you must contact us directly in order to receive the tax exemption. All reservations and orders placed thru www.southpadreislandadventures.com and our other web domains are displayed with tax.
